The following terms and conditions document is a legal agreement between Dana Web Design (DBA WebJut) hereafter "Developer or DWD" and "Client" for the purposes of web site design or development. These Terms and Conditions set forth the provisions under which the Client may use the services supplied.
Developer is a web design, hosting and marketing solution provider offering the Client website design, marketing, hosting and domain registration.

2.ACCEPTANCE OF WORK
Quotations are valid for 15 days from date of issue.
DWD will carry out work only where an invoice has been paid by the Client for the work, unless otherwise agreed at Developers discretion.
When the Client places an order to purchase a web site or any other service from the Developer, the order represents an offer to Developer which may be accepted by Developer only when the order status is confirmed by Developer.
Any other services on the order which have not been included in the initial quote do not form part of the contract. The Client agrees to check the details of the invoice are correct and should print and keep a copy for their records.
Developer is liable to withdraw from contract at any time prior to acceptance.
Additional work requested by the Client which is not specified in the agreed quotation is subject to an additional quotation by the Developer. If the work is needed as part of an existing project then this may affect delivery time of the project.
Client agrees to provide any needed information and content required by Developer in good time to enable Developer to complete a design or web site work as part of an agreed project.

3.PERMISSION AND COPYRIGHT
All pages, images, text and code on Developer's web site at http://www.DanaWebDesign.com/ is copyrighted material. DWD provides at a cost or free limited royalty free media (images/videos etc.) which should not be transfered to any other third party or friends. DWD keeps a copy of copy right agreement on the account which will only provided to the specific domain that the website has been built on. DWD is not responsible for copy right related issues of the content (including images, videos and text) provided by clients. 

4.MATERIAL
Developer reserves the right to refuse to incorporate:
a) Any media or content which is unlawful, obscene or inappropriate;
b) Any media or content which contains a virus, malware or hostile program;
c) Any media or content which constitutes harassment, racism, violence, obscenity, harmful intent or spamming
d) Any media or content which constitutes a criminal offense, infringes privacy or copyright

5.DOMAIN NAMES AND HOSTING
The Developer can at it's own discretion, but is not obliged to, offer domain name registration and hosting via a third party service.
The Client agrees that registration of a domain name does not provide endorsement of the right to use the name. The Client is responsible for ensuring they have due title to the domain name. The Developer holds no liability and the Client hereby agrees to indemnify and hold harmless the Developer from any claim resulting from the Client's registration of a domain name.

6.CUSTOM WEB DESIGN PACKAGE
For web site graphic designs as part of the "Custom web design package" offered on the web site Developer will design a layout of the site based on specifications made by the Client in the order form and as agreed by Developer. All pages of the site will use the same design layout which will surround the center content to the top, left, right and bottom of the page. Developer reserves the right to quote separately for any additional different design layouts to surround the center content to the top, left, right and bottom of any page.

7.WEB DESIGN REFUND POLICY
DWD offers full refund if the first draft is rejected by the client. No refund is granted if clinet fails to approve or reject teh website after three months  starting the date when the first draft is presented to the client on a a test server (the refund does not include additional personalized development of software, plugin, graphic design, logo design  and any aditional items not included in the design package). However, Developer does not offer any refund if client:
a) loses its license
b) goes out of business
c) death of owner
d) is hosting the website (If website is hosted on a serverhosting that is controlled by the client)
e) abandons the production (See item 8 below)
f) is loosing interest or any other condition where the website does not come to use anymore.

Therefore, DWD offers refund if client is not happy with the first draft of the design or website performance and can not be fixed by Developer and client needs a new website for their business and therefore the client would like to hire a different agency or designer.

Until the client's new website is up and running at a comparable or improved functionality or design no refund will be made.

If a website is moved to the clinet-controlled server or hosting no refund will be provided because the client has full ontrol over the code and can copy, use or sell it. 

8.ABANDONMENT OF THE PROJECT
If for any reason a client abandons the website under progress or loses interest in the project or can not provide content for the website after three months starting initial contract the website will be removed from the test server and no refund of any kind will be granted. The re-installment of the website will require a new quote and a new down payment.

9.COPYRIGHT URL LINK OF DESIGNER
For any website design DWD may leave the URL of the developer's website at the bottom of the designed page unless agreed differently. This link shall not be removed.
